Terms of Use

These Terms of Use (“Terms”) are an agreement between you and Tivrela (“we”, “us”), the operator of tivrela.com (the “Website” or “Service”). Please read them in full before using the Website. By accessing the Website, signing up, or posting any content, you confirm that you have read, understood and agreed to these Terms, including our Privacy Policy, which forms part of these Terms. If you do not agree, please stop using the Website. These Terms are also published in Thai. If the two versions differ, the Thai version prevails.

1. The Tivrela service

Tivrela is a travel information website for Thailand. It provides information on places to visit, weather and air-quality forecasts, the best times to go, trip-planning tools and maps, and a members’ area where you can check in, track your travel stats, and share photos, videos and trips with others. Most of the Service is free.

2. Who can use Tivrela

  • You must have the legal capacity to enter into these Terms.
  • If you are under 20, you need consent from a parent or legal guardian before signing up or posting content.
  • Children under 10 may not sign up themselves. A parent or guardian must do so on their behalf and give consent.

3. Member accounts and security

  • Sign up with a mobile number that is genuinely yours. Each number can have only one account.
  • Your display name must not impersonate another person, brand or organisation, and must not be offensive or infringe anyone’s rights.
  • Keep your password secret. Do not let anyone else use your account, and do not buy, sell or transfer accounts.
  • You are responsible for all activity on your account. If you think someone else has accessed it, change your password immediately and let us know.
  • We may send a one-time password (OTP) by SMS to verify your number or reset your password.

4. Check-ins and location

  • To check in, you must be near the actual place. The Website asks for your device location to confirm this and uses it only with your permission.
  • Do not fake your location, use helper apps, or use any other method to check in somewhere you have not actually been. Stats, stamps and the passport book must reflect real trips.
  • We may cancel check-ins, stats or stamps obtained dishonestly.

5. Content posted by members

“Member Content” means anything you upload or write on the Website, such as photos, videos, captions, trips, reviews, comments, messages, display names, profile pictures and cover images.

5.1 You must own it, or have permission

Every time you upload or post, you confirm and warrant that:

  • You created the work yourself (you took the photo, shot the video or wrote the text), or you have the copyright owner’s written permission to publish it.
  • The content is not copied, downloaded or screenshotted from Google, other websites, other people’s social media, books or any other media without permission.
  • If an identifiable person is a main subject of a photo or video, you have that person’s consent, and for a child, the consent of their parent or guardian.
  • The content does not infringe any copyright, trademark, privacy, image right or other right of anyone else, and is not unlawful.
  • Reviews and information you write are based on your own real experience.

If any of these statements is untrue, you alone are responsible for any resulting damage, including any claim a rights holder brings against us.

5.2 You keep your copyright

We do not own Member Content. The copyright stays with you or with whoever gave you permission to use it.

5.3 The licence you give Tivrela

When you post Member Content, you grant Tivrela a non-exclusive, royalty-free, worldwide licence, with the right to sub-license to service providers who help us run the Website, to:

  • display it anywhere on the Website, such as place pages, galleries, the feed, maps, profiles and pages in other languages;
  • store, back up, resize, crop, compress, convert and remove hidden metadata from files, so they display well and safely;
  • translate the text you write into other languages;
  • use it alongside our content and share it on Tivrela’s social media channels, with credit to your display name;
  • show it on pages that carry advertising, affiliate links or other forms of revenue.

This licence covers content you set as public. Content you set as private is visible only to you. The licence ends when you delete the content or your account, except for backups the system keeps temporarily and anything already shared externally before deletion, which we will try to remove where possible if you ask.

5.4 Public and private

You choose whether each check-in or photo is public or kept just for you. Public content can be seen by anyone on the internet, including search engines, and may be saved or shared by others. Think before you post, and do not post personal information such as phone numbers, home addresses or ID numbers.

6. What you must not do

  • Post other people’s photos, videos or text without permission.
  • Post content that is illegal, sexually explicit, exploits children sexually, is violent, supports terrorism, or promotes hatred against any group.
  • Defame, threaten, bully or harass anyone, or reveal another person’s personal information.
  • Post spam, hidden advertising, sales posts, scam links, or fake reviews, whether positive or negative.
  • Impersonate another person or organisation.
  • Fake your location or cheat the check-in and stats system.
  • Scrape the Website with automated tools in bulk, or for commercial use, without permission.
  • Hack the Website, test it for vulnerabilities without permission, upload viruses, or disrupt how it works.
  • Use the Service in any way that breaks Thai law or any other applicable law.

7. Moderation, removal and suspension

  • We are not obliged to review all Member Content in advance, but we may review, hide, change how it is displayed, or remove any content we consider to break these Terms, to be inappropriate, or to risk causing harm.
  • We may warn, restrict, temporarily suspend or close accounts that break these Terms. In serious cases we may do so without notice.
  • We may keep and hand over information to government authorities when the law requires.

8. Reporting copyright or other infringement

If you own the copyright (or are authorised to act for the owner) and find your work posted on Tivrela without permission, or find content that infringes your rights, please contact us with:

  • your name and contact details;
  • the link to the page where the content appears;
  • details of the original work and proof of ownership, such as the original file or a link to where it was first published;
  • a statement that the information you have given is true and that you did not permit the use of the work.

We will review the report and promptly hide or remove the content, and notify the member who posted it. A member who believes content was removed by mistake may object and provide evidence. Members who infringe repeatedly will have their accounts closed. Knowingly making a false report may be an offence under the law.

9. Tivrela’s intellectual property

The Tivrela name, logo, website design, software, articles, and the information we have collected and compiled belong to Tivrela or our licensors. You may not copy, reproduce, adapt or use them commercially without our written permission. Sharing links, or quoting briefly with credit and a link back, is fine.

10. Images and information from other sources

Some images are used under Creative Commons licences and carry credit to their creators and the licence. Maps use data © OpenStreetMap contributors, weather data comes from Open-Meteo, and accommodation information and images come from Agoda. Rights in that material belong to their respective owners.

11. Accuracy of information and travel safety

  • Weather forecasts, PM2.5 levels, best-day scores, opening hours, entry fees, costs, travel times, distances and accommodation prices are for guidance only. They may be inaccurate, out of date, or change at any time.
  • Please check with the place, the authorities or the provider directly before you travel, especially during severe weather, disasters or public holidays.
  • Travel, outdoor activities, driving and visiting natural areas involve risk. You are responsible for judging your own safety and health and for following site rules and the law.
  • Member Content reflects the views of the members who post it, not those of Tivrela.

12. Affiliate links and third-party services

  • Some links on the Website are affiliate links, such as Agoda accommodation links and cards. If you click and book through these links, Tivrela may earn a commission from the provider, at no extra cost to you.
  • Which places and travel information we show does not depend on commissions.
  • Accommodation prices shown are estimates from the provider at the time the data was fetched. Actual prices, availability and conditions are those the provider shows when you book.
  • Bookings, payments, cancellations and refunds are agreements between you and that provider directly. Tivrela is not a party to them and is not responsible for third-party services.
  • Links to other websites, such as Google Maps or a place’s own website, are governed by that website’s terms and policies.

13. Limitation of liability

We provide the Service “as is” and “as available”. We work to keep information accurate and the Service running, but we do not guarantee that it will be error-free, uninterrupted, or always accurate and complete. To the fullest extent permitted by law, Tivrela is not liable for indirect or special damages, loss of income, or damage arising from using or being unable to use the Service, from travel decisions based on information on the Website, from other members’ content, or from third-party services. Nothing in these Terms excludes liability that the law does not allow to be excluded.

14. Indemnity

You agree to compensate and protect Tivrela against claims, damages and costs arising from content you post, your breach of these Terms, or your infringement of anyone else’s rights.

15. Deleting your account and ending the Service

  • You can delete your account at any time from your profile page, or ask us to delete it. When you delete your account, your content and data are deleted as described in the Privacy Policy.
  • We may improve, change, suspend or end all or part of the Service. If a change significantly affects members, we will give reasonable notice.

16. Changes to these Terms

We may update these Terms from time to time. The latest version will always be on this page with its update date. For significant changes, we will post a notice on the Website. If you keep using the Website after the effective date, you accept the new version.

17. Governing law

These Terms are governed by the laws of the Kingdom of Thailand, and related disputes fall under the jurisdiction of the Thai courts. If any part of these Terms cannot be enforced, the rest remains in effect.
